Terms of service

Article 1 (Scope and Consent)

  1. Nakamura Tokichi Honten Co., Ltd. (hereinafter referred to as "the Company") establishes these Terms of Use regarding the use of the international online store and related services (hereinafter referred to as "the Service") operated by the Company.

  2. By using the Service, the user is deemed to have agreed to all the terms and conditions of these Terms.

  3. The user is deemed to have represented that they have reached the age of majority in their country or region of residence.

Article 2 (Modification of Terms)

The Company may modify the contents of these Terms at any time without obtaining the individual consent of the user. The modified Terms shall become effective at the time they are posted on this site.

Article 3 (Member Registration and Management)

  1. Users shall apply for membership registration in accordance with the method specified by the Company.

  2. Users are solely responsible for managing the member ID and password they have set. They may not be transferred, lent, or disclosed to a third party.

  3. The Company shall not be held liable for any damage caused by inappropriate management of the member ID or unauthorized use by a third party.

Article 4 (Ordering and Formation of Contract)

  1. A sales contract between the user and the Company is established at the time the Company sends an email notifying the user of the shipment of the product.

  2. The Company reserves the right to cancel an order even after the contract has been formed in cases of system errors (incorrect pricing), import restrictions, or identified resale purposes.

Article 5 (Pricing, Payment, and Customs Duties)

  • Price Composition: Prices displayed generally include product price, shipping costs, fuel surcharges, and administrative fees.

  • Customs Duties and Taxes: Product prices do NOT include customs duties, import consumption taxes (VAT, etc.), or customs clearance fees in the destination country. These shall be borne by the user as the importer.

  • Exception (DDP): In specific countries, the Company may collect an estimate of these taxes at checkout (Delivered Duty Paid - DDP).

  • Additional Costs: Any special local taxes (state taxes, etc.) imposed separately shall be the responsibility of the user.

Article 6 (Delivery and Transfer of Risk)

  1. Ownership and risk of loss pass to the user at the time the Company delivers the product to the carrier (e.g., DHL).

  2. The Company is not responsible for delays/damage caused by customs inspections, local holidays, or weather.

  3. The Company is not responsible for any loss or theft occurring after delivery to the designated location (e.g., front door/porch).

Article 7 (Cancellation, Return, and Refund Policy)

  • No Returns or Exchanges: Due to the nature of our products as food items, we cannot accept returns, exchanges, or cancellations after shipment for any personal reasons.

  • Cancellation Deadline: Changes or cancellations are only accepted if contacted by 1:00 PM (Japan Standard Time) the day after the order date.

  • Refusal to Receive: If a product is returned or destroyed due to refusal to pay customs duties or long-term absence, NO refund or reshipment will be provided.

  • Damaged Items: If there is a significant defect, contact us within 14 days of shipment with photographic evidence of both the shipping box and the product.

Article 8 (Suspension of the Service)

The Company may suspend the Service without prior notice for: (1) Periodic or emergency system maintenance. (2) Force majeure (fire, power outage, natural disasters, etc.). (3) Other cases where suspension is deemed unavoidable.

Article 12 (Governing Law and Jurisdiction)

  1. These Terms shall be governed by the laws of Japan.

  2. Any disputes shall be subject to the exclusive jurisdiction of the Kyoto District Court as the court of first instance.
